Hawaii TRO and 9th Circuit En Banc Denial effectively strip Trump of executive powers
"...Trump has been stripped of his constitutional and statutory powers to protect the nation through control of who is permitted to enter the country. I warned about this, and the danger of Trump not seeking Supreme Court review in the first case... And now it’s playing out.
Trying to narrow and modify the 1st Executive Order has proven fruitless. The District Court in Hawaii issued a Temporary Restraining Order staying Trump’s 2nd Executive Order on immigration.
The short version of the decision is that Trump said bad things on the campaign trail, so anything he does that disproportionately affects Muslims seeking to enter the country must be motivated by religious bias. ...It doesn’t matter to the court that the six countries covered by the 2nd Executive Order have unique security risks because they have large Islamic Jihadist elements and non-functioning governments..."
I agree: Trump should have taken it to the Supremes immediately. As much as they have arrogantly abused their power in the past, it would still be shocking if they tried to usurp the command powers of the Commander-in-Chief.
The one island of sanity in the Sea of Judicial Jihad was the wise dissent issued by 9th Circuit Judges BYBEE, KOZINSKI, CALLAHAN, BEA, and IKUTA, on the previous insane ruling:
"I regret that we did not decide to reconsider this case en banc for the purpose of vacating the panel’s opinion. We have an obligation to correct our own errors, particularly when those errors so confound Supreme Court and Ninth Circuit precedent that neither we nor our district courts will know what law to apply in the future. The Executive Order of January 27, 2017, suspending the entry of certain aliens, was authorized by statute, and presidents have frequently exercised that authority through executive orders and presidential proclamations. Whatever we, as individuals, may feel about the President or the Executive Order, the President’s decision was well within the powers of the presidency, and “The wisdom of the policy choices made by the President is not a matter for our consideration.”"
That's exactly right.
President Trump's motives don't matter. Whether it is pure bigotry, pure wisdom or pure random choice made by throwing darts at the wall, reading goat entrails or spinning Obama's Wheel of Treason, it is the Executive's decision alone to make.
If we are going to address motives, however, let's also address the radical political motives of these "judges".
They want to ruin Trump, create a Constitutional Right to Enter the United States by every person on the planet and establish group quotas that say if Muslims are a fifth of the world's population, then they must also constitute a fifth of all immigrants to America.
In short, they want to Abolish America.
The Constitution, Trump and us all stand in their way.

If courts are going to apply judicial weight to campaign statements, then maybe I should file a petition for rehearing with the Supreme Court in the ObamaCare case, since “if you like your doctor you can keep your doctor” and “your premiums will go down by $2500” were integral parts of Obama’s sales pitch.".......
If Campaign Promises are the standard, Your Honor, what about the promises Mohammed made to his followers during his military campaigns; that they could treat themselves as first-class citizens, their women as second-class citizens, infidel men as third-class citizens and infidel women as fourth-class property?
